Terms of Service

These terms govern your use of dagarias.com and any purchase from Dagarias. Using the site or placing an order means you accept them. They're written to be read.
- Who we are. Dagarias is a fine diamond jewellery house. Its contracts are governed by the laws of British Columbia, Canada. This site and its contracts are offered in English; French versions of the policies are available on request.
- Orders. Where the price is at or under CA$1,000,000, both loose diamonds and made-to-order pieces are bought through checkout on this site, and your order exists when payment (or an approved financing plan) is confirmed. Above CA$1,000,000 a person is involved: the piece is bought through a written quote covering the design, the stone, the full price, the deposit, and the lead time, and the order exists once you countersign that quote. The same quote path is open to you at any price if you would rather not use checkout. A made-to-order piece bought through checkout is not put into production for 48 hours after payment; cancel within that window and you are refunded in full. A commission begins, and becomes non-refundable, when you countersign the written quote. The deposit is taken at that moment and not before. Until then nothing is owed. Either way we confirm the order to you in writing with your timeline. Reserving an item takes no payment, places no obligation on you, and simply asks us to hold it and contact you.
- Pricing. Prices are in Canadian dollars unless stated otherwise. Where you buy through checkout, the price at checkout is the price. Where you buy through a written quote, the price on that quote is the price, held for the period stated on it. Diamond markets move, so unpurchased site prices may change, and we correct obvious pricing errors. What we will never do is change the price of an order you have already placed.
- Payment & financing. We accept payment by card and other methods offered at checkout, processed by Stripe. Instalments may be offered at checkout to residents of Canada, subject to provider approval and the provider's limits. Whether a plan is available for a given purchase is determined by the payment provider rather than by us. For pieces beyond direct checkout, payment terms are discussed privately in consultation. An instalment plan is an agreement between you and that provider, on their terms. We do not set your instalments, and missed payments are governed by their terms rather than ours. Your statutory rights against us are unaffected by how you choose to pay.
- Certification & descriptions. Every loose diamond we sell carries its own report from an independent laboratory, never graded in-house, and the report travels with the stone. A finished piece at 0.30 carat total diamond weight or more carries an IGI jewellery report for the piece as a whole: the diamonds are graded as set, with their total carat weight, colour and clarity stated for the piece. A single stone of 1 carat or more also carries its own diamond certificate, and the product page names the laboratory. Below 0.30 carat total a piece is not certified and we say so on its page. The smaller diamonds in a piece are matched to the house specification and are not individually graded, which is the practice across the trade. The grades are the laboratory's, not ours, and we present them as issued. Product images are computer renders unless marked as photographs. We take care that images and descriptions are accurate; minor variations between an image and a finished piece are inherent to the craft, most of all in made-to-order work and in how metals render on screens. Where imagery shows a different metal than selected, the written specification governs.
- Returns & trade-up. Per our Returns & The Guarantee policy, which forms part of these terms: loose curated stones carry a 30-day right to return for a full refund (unworn, original condition, certification intact). A piece bought through checkout carries two separate clocks of its own. Before production, it may be cancelled for a full refund within 48 hours of payment, during which we do not begin making it. After delivery, it may be sent back within 10 days of delivery, with no reason asked and return shipping paid by us, for house credit worth what you paid plus 10% (up to CA$500), on your first return, or your money back in full to the card you paid with. The refund is yours by right and not by negotiation. A piece bought through a written quote is a commission rather than a catalogue purchase: it has neither of those windows and is not refundable once you countersign, which is what begins production. Our guarantee below runs on its own separate windows and is unaffected by any of these clocks. Natural stones purchased from us carry a lifetime trade-up credit of 100% of the original stone price toward any natural stone priced at least 2x the original, one active trade at a time; trade-up is not offered on lab-grown stones.
- Delivery. Per our Shipping & Delivery policy, which forms part of these terms. International recipients are responsible for import duties and local taxes.
- Our guarantee. Two promises, each with its own window running from the day your parcel is delivered. If the stone you receive does not match its independent grading report, tell us within 7 days of delivery and we repair, replace, or refund it in full. If a piece develops a making fault, meaning a failure showing it was not made correctly rather than a failure caused by wear, impact, or anything done to it after delivery, we put it right for 24 months from delivery. Every claim is examined under magnification and the finding is given to you in writing whichever way it goes; where the reading is genuinely ambiguous we treat it as a making fault. The guarantee does not cover normal wear, impact or accidental damage, stones lost through knocks or snags, resizing or repair or alteration by anyone other than us, chemical and cosmetic damage, use the piece was not made for, or loss and theft. The full criteria and the complete list of 9 exclusions are set out in our Returns & The Guarantee policy, and nothing is excluded that is not named there. This guarantee is in addition to, and does not limit, your rights under applicable consumer protection law, which are not subject to the windows above.
- Care plans. We are working on care plans for house pieces. They are not open yet, and we are not putting a date on it. We will say so here when they are.
- Your conduct. You agree not to misuse the site: no scraping our catalogue, no interfering with the site's operation, no using our imagery or text without permission.
- Intellectual property. The Dagarias name, our product names, stories, photographs, and site content belong to us or our licensors. Looking is encouraged; taking is not.
- Liability. Nothing in these terms excludes liability that cannot be excluded by law. Beyond that, our liability for any order is limited to the amount you paid for it. We are not liable for delays or failures caused by events beyond our reasonable control.
- Privacy. Our Privacy Policy forms part of these terms.
- Changes. We may update these terms; the version on this page at the time of your order is the one that applies to it.
- Governing law. These terms are governed by the laws of British Columbia and Canada. Any dispute belongs to the courts of British Columbia. We would rather you simply wrote to us first. Nearly everything can be made right faster that way.
